Is it mandatory to register a partnership firm?

Although the registration of a partnership firm is optional and at the partners’ discretion, it is always better to register the business. With registration as a partnership firm, you can enjoy special rights that may not be available to the unregistered ones.

The Indian Partnership Act, 1932, covers the partnerships in India. The registration process can be initiated at any time – before starting the business or any time during the continuation of a partnership.

What is the process of registration of the partnership firm?

One has to fill up the registration form along with the fee and submit it to the Registrar of Firms of the State where the firm is located and will conduct its business. All the firm partners need to sign the form, or they can get it done through their authorized agents.

What the documents required to be submitted to the Registrar?

The following documents are to be submitted to the Registrar:

  • Form 1: Application for registration of partnership
  • Specimen of Affidavit
  • Certified original copy of Partnership Deed
  • Proof of principal place of business (ownership documents or rental/ lease agreement)

How much time does it take to register a partnership firm?

The registration process can take up to 12 to 14 days. However, the duration of the process from submitting the application process to the issuance of Certificate of Incorporation varies from one state to another.
