The tax is paid and collected at a pre-determined slab rate. Depending on the state, it is managed by the commercial tax department on an annual or monthly basis. The tax is paid directly by a self-employed person or trade/business owner. It is the responsibility of the employer to deduct and deposit such tax to the State Governments.
What is a Certificate of Enrolment as required by self-employed persons?
Every employer who deducts the tax from the employees’ salary and pays it to the state government needs to obtain the Certificate of Enrolment.
Who is responsible for collecting and depositing professional tax with the governments?
The duty to pay/ deduct and deposit the professional tax rests with the taxpayers as follows:
- Self-employed person: Himself
- Employed person: His employer
Can a lump sum payment be made for the professional tax liability?
Yes, some states have initiated the composition scheme, under which a lump sum amount can be paid, and the individual will be discharged for the professional tax liability for a stipulated period.
Who are all exempted from paying the professional tax?
The following individuals will be exempted from paying the professional tax:
- Parents of children with a permanent disability
- Members of the armed forces, including auxiliary forces serving in the state.
- Individuals over 65 years of age
- Women working exclusively under Mahila Pradhan Ksehtriya Bachat Yojana.
